Ordinance No. 1131

SECTION 1.  BURNING LIMITED

A.  Within the corporate limits of the City, the open burning of residential yard waste
            Consisting of leaves and brush from vegetation grown on a residential property is permitted within the                       conditions defined in Section 2.

B.The burning of garbage, tires, fabric, furniture and other kinds of waste is prohibited.

SECTION 2.RESTRICTIONS ON BURNING YARD WASTE

THE BURNING OF YARD WASTE SHALL BE CONDUCTED AS    FOLLOWS:

A.      All fires must be at least 20 feet away from any building, structure on property line. At no time
        shall a fire be located on the surface of a city street.

B.Fires shall be limited to an area no greater than ten feet (10”) in diameter or length at
          any one time. Fires at multiple sites on the same property are prohibited.

C.Fire fighting material sufficient to contain any fire started under this section shall be available   at            the site of  the burning.

D.Open burning shall be permitted only between the hours of 8:00 AM and 8:00 PM and only  
         between the   dates of November 10th and November 25th in any calendar year.

E.All fires shall be monitored from a point on the property where the fire is located by a person
          capable of containing a fire, should containment be necessary. A minor child is not a person   
          considered capable of containing a fire.

F.If the safety of the community or the public health may be endangered, or climatological
         conditions indicate  open burning may crdate a health hazard, the Mayor or the Fire Chief of the              Lathrop Fire District may invoke a temporary burning ban.
 
G.Any person engaged in open burning in violation of this ordinance shall be summoned for  a                   misdemeanor  violation.

SECTION 3.  APPLICATIONS WHERE THIS ORDINANCE DO NOT APPLY ARE AS
                        FOLLOWS:

Fireplaces and heating stoves located wholly within a residence wood burning stoves located in    garages or sheds, outdoor barbecues for the preparation of food, properly supervised fires set for recreational or ceremonial purposed and supervised burning of paper products where the fire is contained within a barrel or similar container.
